Who needs to file Form 5472?
Any U.S. single-member LLC that is treated as a disregarded entity for federal tax purposes and is 100% owned by a foreign person (individual or company). If that describes your situation, you likely need to file Form 5472 along with a Pro Forma 1120 every year, even if the LLC had no income. The IRS penalty for missing this is $25,000 per form, per year.
What is the filing deadline?
For most single-member LLCs, the filing is due April 15 of the year following the tax year. If you need more time, you can file Form 7004 to get a six-month extension — but the extension applies to the filing, not to any tax owed. We recommend filing early and not waiting until the last week of March.
What do you actually send to the IRS?
We generate a PDF package that contains a Pro Forma Form 1120 (the cover page the IRS requires for disregarded entities) and Form 5472 with your information filled in. We transmit this package to the IRS Ogden, Utah processing center by fax using Sinch's certified fax service. You receive a copy of the PDF and we retain the transmission log.
How do I know the fax was actually delivered?
When we send your filing, Sinch provides a fax transmission ID and a delivery acknowledgment from the IRS fax line. This is reflected as "Filed ✓" in your dashboard. We log the timestamp and confirmation ID. Note that fax acknowledgment from the IRS confirms the transmission reached the fax line — it is not the same as the IRS processing the return, which they do internally.
Can I get a refund?
Yes, if your filing has not yet been transmitted. Once we have sent the fax to the IRS, the fee is non-refundable because the service has been performed. To request a refund before transmission, email [email protected] with your filing ID. We process refund requests within one business day.
My LLC had zero transactions this year. Do I still need to file?
Yes. The IRS requires the filing even if there were no reportable transactions. A "zero transaction" filing is still a filing. You'll complete Part III of Form 5472 to indicate no transactions occurred, which is exactly what our wizard supports.
I entered the wrong EIN. What do I do?
If your filing hasn't been transmitted yet, go back to the LLC Info step in the wizard and correct it before completing checkout. If the fax has already been sent, email [email protected] immediately. Incorrect information that has been transmitted to the IRS may require you to file an amended return, which is outside the scope of this service.
Is my data secure?
Yes. All personally identifiable information — your name, EIN, tax identification numbers, and addresses — is encrypted at rest using AES-256-GCM before it is written to the database. Each field uses a unique random nonce. The encryption key is stored separately from the database. Connections are HTTPS-only. You can read the full details in our Privacy Policy.
Do you offer tax advice?
No. AkamindTax is a self-service compliance filing platform. We are not a law firm and not a CPA firm. Nothing on this platform is legal or tax advice. If you have questions about whether Form 5472 applies to you, or about your specific tax situation, you should consult a licensed tax professional.
What if I have multiple LLCs or a more complex structure?
This service is built specifically for a single-member disregarded LLC owned by one foreign person. If you have multiple LLCs, you'll need to submit a separate filing for each one. If your structure is more complex — multiple owners, a corporate structure, or an S-Corp election — this service may not be appropriate and you should work directly with a CPA.
